1. Agreement to Terms

By accessing or using Lightning Data CRM ("the Service"), operated by Lightning Data CRM ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Lightning Data CRM is a customer relationship management platform designed for real estate wholesalers, investors, and related professionals. The Service includes contact management, deal tracking, buyer matching, email campaigns, partner portals, and related features.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Subscription and Billing

The Service is offered on a subscription basis at $60 per month.

  • Free Trial: New users receive a 14-day free trial. No charge is made until the trial ends.
  • Billing: After your trial, you will be billed monthly. Payments are non-refundable except as described in our Refund Policy.
  • Cancellation: You may cancel your subscription at any time from your account settings. Access continues until the end of your current billing period.
  • Price Changes: We may change pricing with 30 days' notice. Continued use after the change constitutes acceptance.

5. Refund Policy

We want you to be satisfied with Lightning Data CRM.

  • 30-Day Money-Back Guarantee: If you're not satisfied within the first 30 days of your paid subscription, contact us for a full refund.
  • After 30 Days: Refunds are not provided after the initial 30-day period. You may cancel at any time, and your access will continue until the end of your billing period.
  • How to Request: Email us at lucas@lightningdatacrm.com with your account email and reason for the refund request.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Send spam, unsolicited emails, or violate anti-spam laws (CAN-SPAM, GDPR, etc.)
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with or disrupt the Service or servers
  • Resell, sublicense, or share your account without permission
  • Scrape, harvest, or collect data from the Service without authorization

7. Your Data

You retain ownership of all data you upload to the Service ("Your Data").

  • You grant us a license to use Your Data solely to provide the Service
  • You are responsible for the legality and accuracy of Your Data
  • You may export Your Data at any time
  • Upon account termination, Your Data may be deleted after a reasonable retention period

8. Intellectual Property

The Service, including its design, features, and content (excluding Your Data), is owned by Lightning Data CRM and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

9. Third-Party Services

The Service may integrate with third-party services (e.g., Stripe for payments, email providers). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIGHTNING DATA CRM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Lightning Data CRM and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Arkansas.
